These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Agrum AI. By creating an account, downloading the App, accessing any part of the Service, or using any features or functionality, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
You must be at least 18 years of age to use this Service. If you are under 18, you may not create an account or use the Service.
By using the Service, you represent and warrant that you are at least 18 years old, you have the legal capacity to enter into this agreement, and you will comply with all applicable laws and regulations.
About This Project: Agrum AI is created by an independent developer passionate about agriculture and technology. This app is provided free to farmers worldwide to support modern farm management. While we strive for quality and reliability, please use professional judgment when making farming decisions.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date, sending an email to your registered address, displaying a prominent notice in the App, and requiring acceptance before continued use.
Continued use after changes constitutes acceptance. If you disagree with changes, stop using the Service and delete your account.
Certain features may have additional terms and conditions. By using those features, you agree to the applicable additional terms.

We strive to provide continuous access but do not guarantee uninterrupted or error-free operation, complete accuracy of AI recommendations, availability during maintenance or updates, or preservation of all data indefinitely.
Some features may be marked as "Beta" or "Experimental". These are provided "as-is" with no warranties, may be unstable, incomplete, or change frequently. Your feedback helps us improve these features. We may discontinue Beta features at any time.
To use the Service, you must provide accurate, complete, and current information, use a valid email address, create a secure password, and maintain the security of your account credentials.
You are responsible for maintaining the confidentiality of your password, all activities that occur under your account, and notifying us immediately of unauthorized access: [email protected]
We are not liable for any loss or damage from your failure to maintain account security.
You agree to provide truthful and accurate information, update your information promptly when it changes, not impersonate another person or entity, and not use someone else's account without permission.
You may only create one account for personal use. Multiple accounts for the same person are not permitted. Commercial users may create one account per farm/business.
Delete your account anytime through App settings or email [email protected] to request account deletion. Your data will be deleted within 30 days (see Privacy Policy).
We may suspend or terminate your account if you violate these Terms, engage in fraudulent or illegal activity, abuse the Service or harm other users, fail to pay applicable fees (if any), or remain inactive for extended periods.
Notice: We'll provide reasonable notice before termination unless immediate action is required for security or legal reasons.
You may use Agrum AI to record and manage your farming operations, access weather information and AI farming advice, organize farm data and generate reports, communicate with our AI assistant, and export and analyze your farm data.
You may NOT:
Violation may result in warning or account suspension, permanent account termination, legal action and liability for damages, or reporting to law enforcement authorities.
We reserve the right to monitor usage for compliance and security, remove or disable content that violates these Terms, investigate violations and cooperate with authorities, and take action without prior notice when necessary.
"User Content" means any data, information, text, images, or other materials you submit, upload, or store in the Service, including farm activity records, financial transactions, crop and field data, notes and observations, messages to the AI assistant, and photos or attachments.
You retain all ownership rights to your User Content. We do not claim ownership of your farm data, records, or any content you create.
By submitting User Content, you grant Agrum AI a limited, non-exclusive, royalty-free, worldwide license to use, store, process, display, and transmit your content solely for the purpose of providing and improving the Service.
This license allows us to store your data on our servers, process your messages with AI to extract activities, display your data back to you in the App, backup and secure your data, and improve AI models and features (in aggregated, anonymized form).
This license ends when you delete your content or account.
You represent and warrant that you own or have necessary rights to your User Content, your content doesn't violate any laws, regulations, or third-party rights, your content doesn't infringe intellectual property, privacy, or other rights, and your content isn't defamatory, obscene, or harmful.
You may not submit content that is illegal, harmful, threatening, or abusive; infringes copyrights, trademarks, or patents; contains viruses or malicious code; violates privacy or publicity rights; or is spam or unsolicited advertising.
We may remove User Content that violates these Terms or our policies, we believe is illegal or harmful, we're required to remove by law, or infringes third-party rights.
We are not obligated to pre-screen or monitor User Content but reserve the right to do so.
You are responsible for backing up your important data. While we maintain backups, we recommend regularly exporting your data through the App, keeping local copies of critical records, and not relying solely on our Service for data preservation.
The Service, including all content, features, and functionality, is owned by Agrum AI and protected by copyright laws, trademark laws, patent laws, and trade secret laws. This includes App code and software, design, graphics, and user interface, logos, branding, and trademarks, AI models and algorithms, and documentation and content.
"Agrum AI," our logo, and related marks are trademarks of Agrum AI. You may not use them without our prior written permission except as necessary to reference the Service.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal or farm business use, download and use the mobile App on your devices, and use the Service in accordance with these Terms.
This license does not include any right to modify, reproduce, or create derivative works; any right to sell, sublicense, or redistribute the Service; any right to use our trademarks or branding; or any right to access source code.
If you provide feedback, suggestions, or ideas ("Feedback"), we may use Feedback without obligation to you. You grant us a perpetual, irrevocable, worldwide license to use Feedback. Feedback is provided voluntarily and without confidentiality obligations. We have no duty to implement or credit Feedback.
The Service uses third-party services and components: Google Gemini AI (AI processing), OpenWeatherMap (weather data), Supabase (database and authentication), Expo (mobile app framework), and various open-source libraries. These third-party services are subject to their own terms and licenses.
If you believe content on our Service infringes your copyright, send a DMCA Notice to [email protected]. Include your name and contact information, description of the copyrighted work, URL or location of the infringing material, statement of good faith belief, statement under penalty of perjury that information is accurate, and physical or electronic signature.
Response: We will investigate and may remove infringing content. Repeat infringers may have accounts terminated.
Our AI assistant provides farm activity extraction from your messages, weather-based farming advice, crop recommendations and insights, and answers to farming questions.
AI-generated content is for informational purposes only and does NOT constitute professional agricultural advice, veterinary advice, financial, legal, or tax advice, pest management or chemical application instructions, or substitute for professional consultation.
You are solely responsible for verifying AI recommendations before acting, making informed decisions about your farming operations, consulting qualified professionals when needed, and complying with agricultural regulations and best practices.
Our AI may make mistakes or provide inaccurate information, miss important context or nuances, give incomplete or outdated advice, or misinterpret your messages. Always use your professional judgment and expertise.
We do not warrant or guarantee accuracy, completeness, or reliability of AI outputs; that AI advice will lead to successful outcomes; that AI will be free from errors or bugs; or that AI will meet your specific needs.
WE ARE NOT LIABLE for any loss, damage, or harm resulting from following AI-generated advice or recommendations, errors or inaccuracies in AI outputs, decisions made based on AI information, or agricultural failures or financial losses. YOU USE AI FEATURES AT YOUR OWN RISK.
⚠️ IMPORTANT: Our AI assistant uses Google Gemini API to process your messages. By using AI features, you acknowledge that Google processes your chat data and may use your data to improve their AI models and services according to their own privacy practices. Google's Terms of Service and Privacy Policy apply to this processing. You can avoid AI processing by using manual data entry features instead.

Weather information is provided by OpenWeatherMap and other third-party sources.
We do not guarantee accuracy or timeliness of weather data, availability of weather services, or suitability for specific farming decisions.
Weather data is for informational purposes only. Do not rely solely on our weather information for critical decisions. Verify weather conditions through official sources. Be prepared for unexpected weather changes. Follow local weather warnings and advisories.
WE ARE NOT LIABLE for losses due to inaccurate weather information, crop failures or damage related to weather, missed weather warnings or alerts, or decisions made based on weather data.
The Service allows you to record income and expenses, track farm financial transactions, and view financial summaries and analytics.
Financial information provided is for record-keeping only and does NOT constitute professional financial advice, tax preparation or advice, accounting services, or investment recommendations.
You are responsible for entering accurate financial information, maintaining proper accounting records, complying with tax laws and regulations, and consulting with qualified accountants or tax professionals.
Agrum AI does not file taxes on your behalf, does not guarantee tax compliance, does not provide tax advice, and recommends consulting with a tax professional.
You may export your financial data for tax preparation, accounting software import, and personal record-keeping. We do not guarantee compatibility with specific accounting software or tax services.
The Service is currently FREE to use. We reserve the right to introduce paid subscription plans in the future, offer premium features for a fee, or charge for certain services or usage limits.
If we introduce paid features, we'll provide 30 days advance notice. Existing free features will remain free (grandfathered). You may opt-out by deleting your account. Payment terms will be provided at that time.
If we offer free trials of paid features, free trial terms will be clearly stated. You may cancel before trial ends to avoid charges. Auto-renewal will be disclosed upfront.
If we charge fees in the future, refund policy will be provided at that time. Generally, subscription fees are non-refundable. Exceptions may be made at our discretion.
Our Privacy Policy explains how we collect, use, and protect your personal information and farm data. By using the Service, you agree to our data collection and use practices, data sharing with third-party service providers, and international data transfers (if applicable).

The Service integrates with Google Gemini AI (AI processing and chat functionality), OpenWeatherMap (weather data and forecasts), Supabase (database and authentication services), and Resend.com (email delivery for OTP and password resets).

If you connect third-party services (e.g., weather apps, accounting software), you grant necessary permissions, you're responsible for those integrations, and we're not liable for third-party issues.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
YOU ARE SOLELY RESPONSIBLE FOR your use of the Service, decisions made based on Service information, farming operations and outcomes, compliance with laws and regulations, and data accuracy and backups.
The Service does NOT provide professional agricultural consulting, certified agronomist advice, licensed pest management services, accredited financial advice, or legal or tax services.
BETA FEATURES ARE PROVIDED WITHOUT ANY WARRANTIES. They may be unstable, incomplete, or buggy; may change or be discontinued without notice; and are not suitable for critical farming operations.
Some jurisdictions don't allow disclaimer of implied warranties. In such cases, disclaimers apply to the maximum extent permitted by law, and certain warranties may be non-waivable.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGRUM AI SHALL NOT BE LIABLE FOR ANY:
EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IF LIABILITY EXISTS (DESPITE ABOVE LIMITATIONS): Our total aggregate liability shall not exceed $100 USD (One Hundred US Dollars), or fees paid by you in the 12 months prior to the claim (if Service becomes paid), WHICHEVER IS GREATER.
These limitations reflect an allocation of risk and are a fundamental part of our agreement. We would not provide the Service without these limitations.
If a limited remedy fails of its essential purpose, the above limitations still apply to the fullest extent permitted by law.
Some jurisdictions don't allow limitation of liability for certain damages. In such cases, limitations apply to the maximum extent permitted, and liability for gross negligence or willful misconduct may not be limited.
YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS Agrum AI, its officers, directors, employees, agents, and affiliates from claims arising from your use of the Service, your violation of these Terms, your violation of any rights of another person, your User Content, and your farming operations or decisions. INCLUDING legal fees and costs of defending such claims.
These Terms are governed by the laws of California, United States, without regard to conflict of law principles.
Before filing a claim, you agree to: Contact us at [email protected], describe the dispute in detail, and allow 30 days for us to resolve the issue amicably. Most disputes can be resolved through good-faith negotiation.
IF INFORMAL RESOLUTION FAILS: Disputes shall be resolved through binding arbitration conducted by American Arbitration Association (AAA) under their rules and procedures in Los Angeles County, California or online/phone.
The following may be brought in court: small claims court actions (if within jurisdiction limits), injunctive or equitable relief to protect intellectual property, and enforcement of arbitration award.
YOU AGREE NOT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS. All disputes must be brought individually. No consolidation with other claims or users. This waiver may be severable if deemed unenforceable.
Arbitration under AAA Consumer Arbitration Rules. One arbitrator mutually agreed upon or selected per AAA rules. Arbitrator's decision is final and binding. We pay arbitration filing fees (subject to AAA rules). Each party bears their own legal fees (unless awarded by arbitrator). Arbitrator may award attorneys' fees to prevailing party. Limited discovery as determined by arbitrator, focusing on efficiency and cost-effectiveness.
IF ARBITRATION DOESN'T APPLY OR IS DEEMED UNENFORCEABLE: Any court proceedings shall be brought exclusively in courts located in Los Angeles County, California. You consent to personal jurisdiction and venue in those courts.
YOU WAIVE YOUR RIGHT TO A JURY TRIAL for any disputes resolved in court.
Claims must be brought within one (1) year of when the claim arose. After one year, claims are barred.
Notwithstanding arbitration, either party may seek temporary or preliminary injunctive relief in court to protect intellectual property or prevent irreparable harm.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Agrum AI regarding the Service. These Terms supersede any prior agreements, understandings, or representations.
If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary, and remaining provisions remain in full force and effect.
Our failure to enforce any right or provision doesn't constitute a waiver of that right or provision. A waiver of any breach doesn't waive future breaches.
By You: You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
By Us: We may assign our rights and obligations to an affiliate or subsidiary, in connection with a merger, acquisition, or sale of assets, or to any successor or assign.
These Terms are solely for your benefit and ours. No third party has any rights under these Terms.
We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, or civil unrest, government actions or regulations, Internet or telecommunications failures, pandemics or public health emergencies, or third-party service outages.
Nothing in these Terms creates an employment relationship, a partnership or joint venture, an agency relationship, or any fiduciary duties.
To You: We may send notices by email to your registered address, through the App (push notifications or in-app messages), or by posting on our website. Notices are effective when sent.

You agree not to export, re-export, or transfer the App or Service in violation of U.S. export laws or other applicable export control laws.
If you're a U.S. government entity, the Service is "Commercial Computer Software" and "Commercial Computer Software Documentation" as defined in federal acquisition regulations. Government users have only those rights specified in these Terms (consistent with FAR 12.212 and DFARS 227.7202).
The following provisions survive termination of these Terms: User Content licenses, Intellectual Property Rights, Disclaimers and Warranties, Limitation of Liability, Indemnification, Dispute Resolution, and General Provisions.
If you download the App from Apple App Store or Google Play Store, you agree to Apple's or Google's Terms of Service, respective usage rules and guidelines, and in-app purchase terms (if applicable).
Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and install the App on devices you own or control for personal or farm business use only.
We may release updates, patches, or new versions; require updates for security or functionality; discontinue support for older versions; or change features or functionality. You should keep the App updated for best performance and security.
The App requires compatible mobile device (iOS or Android), Internet connection (for most features), sufficient storage space, and up-to-date operating system. We are not responsible for device compatibility issues.
If we offer in-app purchases: purchases are final and non-refundable (unless required by law), prices may change with notice, payment processed through app store accounts, and subject to app store refund policies.
The App may send push notifications for daily farming advice, weather alerts, activity reminders, and service updates. You can disable notifications in device settings.
Using the App may incur data charges from your mobile carrier. You are responsible for these charges.
The App uses open-source software licensed under various licenses, including MIT License, Apache License 2.0, BSD Licenses, and others.
We acknowledge and thank the open-source community. A complete list of open-source components and their licenses is available in the App (Settings → About → Open Source Licenses).
The Service integrates third-party APIs:
You agree to comply with third-party terms when using integrated services.
Upon termination (by you or us):
If we charge fees in the future, termination doesn't entitle you to refunds. Pro-rata refunds may be offered at our discretion. Termination for cause = no refunds.
We welcome your feedback! You may submit feedback through the App (Settings → Send Feedback) or email [email protected]. You can also rate us on app stores.
By providing feedback, you grant us a perpetual license to use it without obligation or compensation.

If you're not satisfied with our response, you may contact your state attorney general, file a complaint with the FTC (Federal Trade Commission), contact your local consumer protection agency, or seek arbitration or legal recourse (per Section 15).
You acknowledge that agricultural data is unique and valuable, farming decisions are complex and context-dependent, and the Service is a tool, not a substitute for farming expertise.

If you use the Service for crop insurance purposes, verify data accuracy before submitting to insurers. We don't guarantee acceptance by insurance companies. Maintain additional documentation as required by insurers.
We are not responsible for insurance claim denials.
If you grow food crops, follow FDA Food Safety Modernization Act (FSMA) rules, maintain proper food safety records. The Service doesn't ensure FSMA compliance.
If you manage livestock, comply with USDA livestock regulations, follow state animal health requirements, and maintain veterinary records independently.
The Service is not a substitute for veterinary care or livestock management systems.
The Service is NOT intended for users under 18 years of age. We do not knowingly collect information from minors.
If you're a parent and discover your child has created an account, contact us immediately at [email protected]. We'll delete the account and all associated data promptly.
This age restriction is required by our AI service provider (Google Gemini API Terms), the nature of agricultural and business operations, and applicable regulations.
There are no exceptions to this policy, even with parental consent.
The Service is primarily designed for United States users and users with U.S.-based farms or agricultural operations.
We make no representation that the Service is appropriate or available for use in other locations.
If you access the Service from outside the U.S., you do so at your own initiative, you're responsible for compliance with local laws, data may be transferred to and processed in the U.S., and local regulations may not apply or be enforced.
You may not use or export the Service in violation of U.S. export laws, to countries under U.S. embargo, or if you're on a U.S. government restricted party list.
These Terms are in English. If we provide translated versions, they're for convenience only. The English version controls in case of conflicts.
We strive to make the Service accessible to users with disabilities.
The App supports device screen readers (VoiceOver, TalkBack), font size adjustments, high contrast mode, and voice input for AI assistant.
If you encounter accessibility barriers, email [email protected] with details. We'll work to address issues promptly.
We don't guarantee full compliance with all accessibility standards but make reasonable efforts to improve.
We may schedule maintenance that interrupts Service. We'll provide reasonable advance notice (when possible). Maintenance typically during low-usage periods. Most maintenance is brief (<1 hour).
We may perform emergency maintenance without notice to fix critical security issues, prevent data loss, or restore Service functionality.
We're not responsible for outages caused by Internet service provider issues, cloud provider failures (AWS, Supabase), third-party API downtime (weather, AI services), or natural disasters or force majeure events.
We'll make reasonable efforts to restore Service as quickly as possible, communicate status updates, and minimize data loss.
We are not liable for losses during outages (see Limitation of Liability).

We may create community forums or user groups where users can help each other, we share tips and best practices, and community moderators enforce guidelines.
Disclaimer: Community advice is not official support. Follow Terms when participating.
We reserve the right to modify, suspend, or discontinue any feature; add new features or functionality; change service requirements or limitations; and update user interface or design.
For significant changes, we'll provide reasonable notice (30 days when feasible) via email or in-app notification. Continued use constitutes acceptance.
We have no obligation to maintain backward compatibility, preserve all features indefinitely, or provide specific features or functionality.
If we discontinue the Service entirely, we'll provide at least 90 days notice, you'll have opportunity to export your data, and refunds (if applicable) as required by law.
If you delete your account, you have 30 days to reactivate by contacting [email protected]. After 30 days, data is permanently deleted. Reactivation after 30 days may not be possible.
If we suspend your account, we'll notify you of the reason. You may appeal by emailing [email protected]. We'll review and respond within 5 business days. Reinstatement is at our sole discretion.
If your account is permanently banned for Terms violations, you may not create new accounts. Attempting to circumvent a ban may result in legal action.
You consent to receive electronic communications from us, including emails to your registered address, in-app notifications, and updates to Terms or Privacy Policy.
These electronic communications satisfy legal notice requirements.
You may opt-out of marketing emails by clicking "unsubscribe" in marketing emails, emailing [email protected] with "Unsubscribe" in subject, or updating preferences in App settings.
Note: You cannot opt-out of transactional emails (password resets, security alerts).
You may print these Terms for your records. If there's a conflict between the online and printed version, the online version controls.

These Terms shall be interpreted in accordance with their plain meaning, without presumption against the drafting party, and giving effect to the intentions of both parties.
